Since I resigned my position, the company is indicating that they are not required to make the "non-compete" payment. It is my understanding that compensation is due for an agreement to be enforceable. Would I be due the pay since the company terminated my employment at and based on my resignation letter?FrankShttps://www.blogger.com/profile/11711555793998148745noreply@blogger.comtag:blogger.com,1999:blog-1685903630161577363.post-1356782367161567952018-04-13T21:27:20.783-04:002018-04-13T21:27:20.783-04:00Great article. I would just add that at some compa...Great article. I would just add that at some companies high turnover is not a consequence of workplace issues gone awry but actually a labor model. You see, on-the-job training (especially for many office/sales/corporate roles) isn't what it used to be. Nowadays less is being invested in the workforce and more in marketing and c-level relationship building. Companies are willing to invest thousands a day in marketing while throwing pennies to prep someone for their role. Also the longer a person is with a company their seniority justifies higher expectations ergo costs on the employer - pay raise, promotion, better incentives, higher commission rates, longer paid vacations, profit sharing, the list goes on - all this costs money and employers are becoming ultra-sensitive to the "liability" of long term workers. Furthermore, the longer a person works at a company the greater the sense of malicious intent and betrayal if something goes wrong aka lawsuits. Lastly, the longer someone is in a position, the more comfortable and entitled they become and sometimes less productive as the need to prove themselves isn't high on the list. This is also where favoritism comes into play and yet I've seen many people who were "favorites" fall victim to the great Turnover. So, while common wisdom out there suggests companies are still looking to tame high turnover and grow a workforce with longevity, I think in reality employment has undergone a paradigm shift toward desensitization and rationalization of turnover as a cost-benefit win win. Sometimes, labor costs aren't justified so the compensation structure suddenly "changes" or benefits are downgraded. Those spiffs and monthly sales bonuses are conveniently put on hold, until the new round of newbies come begging for a chance to prove themselves! Not to mention you would be going into your new position carrying this heavy weight of why you abandoned your former employer with no one to share it with. In some cases, especially if you have documented the sudden adverse changes to your employment in response to a recent complaint or reasonable request, you may fair better by quitting with good cause. The standard isn't as impossible to meet as the employer-sponsored articles on the internet would lead you to believe. In cases where there are systematic changes or actions against you and you have documented it, it may be better to quit and immediately file for unemployment. There are two caveats - and critical ones: a) you must address the problem in writing and b)you must detail, professionally, the valid reasons for which you are quitting in writing and even provide the employer with an example of how you tried to address the situation. This is a powerful "quit with good cause" email - and every employee should be learn to write them. Far too often, employees quit on "good terms" even after being shafted. Don't fall for that trick. Swallow your pride, be your most professional you, and fight for your rights. Switching jobs isn't always the best option. I'm a young assistant manager. I just got spanked by HR for this: Looking into an applicant, I called the manager of another department within my company where the applicant had formerly worked. The manager told me that the applicant had been a poor performer who quit without notice. She was very professional about it and did not defame the applicant. HR told me that I was wrong and bad and it's illegal to contact his former manager. The internet has a lot of "It's best to get consent" and "be sure to get consent" before doing backdoor reference checks, but I can't find anyone who will commit to questions of legality. Is consent required for reference checks? Or is it only an attempt to reduce defamation lawsuits? Or does it vary by state?
Thanks!Anonymoushttps://www.blogger.com/profile/15544564042917538941noreply@blogger.comtag:blogger.com,1999:blog-1685903630161577363.post-51386243311442996872018-04-04T09:05:23.650-04:002018-04-04T09:05:23.650-04:00Well yesterday I went to work as usually wiping of...Well yesterday I went to work as usually wiping off stuff for items and then I wa told to come to the break room I was told about the shrink problem in store and I was ask did I have any part I told him no for the longest then he said I was seen taking from the literacy fundb which would be like $1-2 dollars he ask how long ago did it start I said since mid last year then he just came up with a number $140 plus the stuff drinks and candy I had gotten but it all comes up to $173.58 I didn’t know what was happening but I sign and didn’t know I had the option not to and then I was told I might get fine but I just wanna know how you can come up with an amount in your head when I bearly work. In a stellar show of ignorance, they violated the ADA and title VII in a single conversation and then fired me when I told them it was a violation for "talking back." I live in a Right-To-Work state. The NLRB has been helpful, but I have no idea what I'm doing and I don't want to get screwed.

This post stood out to me because the employer does have white-house level turnover. I was only there for about half a year and saw three people come and go (And, of course, I was the one that had to pick up their shifts when they quit). This was very insightful, thank you for sharing this and your experience.

I have little/no money in the bank right now, and have called 8 different lawyers that won't help me, saying it's either an ADA case, or a Title VII case, and then bounce me back and forth. The EEOC did not answer their phones. It was stuck at 67 min hold time, and the one time I did get through, the employee quite obviously faked "not hearing me."

Do you have any resources for employees in my situation? I don't know what to do about the negotiation, and the NLRB agent that's been doing the investigation is, well, like you said in an earlier post, super overwhelmed.Nathanhttps://www.blogger.com/profile/07795832974765984695noreply@blogger.comtag:blogger.com,1999:blog-1685903630161577363.post-38155701897788148562018-02-26T22:53:27.895-05:002018-02-26T22:53:27.895-05:00So i think lp is full of shit in my case. What happened was a customer was paying with a card and it was declined, so they paid with another card and paid for 5.83 the total was 170 and some change dont remember. Anyway 5.83 was paid bringing it to 164 and some change... The head lp dude says that he watched me on camera enter in 165.00 "look around" and then cash it out. He also said that there was no interaction with the customer and no "exchange." and this supposedly happened on the 9th of feb. My problem is... That it doesn't make any sense. How was there no exchange when i knew that he/she was going to pay 165.00 in cash? Also the head lp guy was asking phishing questions to see if id admit to doing something on purpose. like if i knew the customers and im like...no... The way lp was talking to me it sounded to me like accusing, but not out right accusing me. Heres my issue and why i think their fos.
1. No video proof.
2.waited a week to tell me about it excuse:scheduling. Especially sense i worked the next 3 days. (Bullshit)

3.knowing me, I would've been freaking tf out if i were 165.00 short..the fact that i was oblivious to this has me calling major bs on the whole thing.
Head lp guy tells me that he not only knows how i am when i get nervous, but knows how all cashier's are... Great then he should know how i take money by now hes been watching for a yr. She did argue that we should ban assault weapons, but that is not the same thing as banning all types of guns. Assault weapons are very different from the guns used by a teenage rifle team.

As for the "laws against killing people but people do it anyway." This is frankly a bad argument. This logic falls apart if you try to apply it to other policies. Passing and enforcing laws may never stop something from happening 100% of the time, but it is still an important step in effective intervention.

It IS about guns. "Guns don't kill people, people do," but guns sure make it easy to kill many people, very quickly. Knives can kill or injure, sure, but they serve other purposes in areas such as cooking. A gun's primary purpose is to kill or injure.Teacherhttps://www.blogger.com/profile/04399297594559132621noreply@blogger.comtag:blogger.com,1999:blog-1685903630161577363.post-47604252168426752002018-02-16T11:25:48.831-05:002018-02-16T11:25:48.831-05:00I'm so sorry that this has hit so close to hom...I'm so sorry that this has hit so close to home for you.
